" The main purpose of the letter was doubtless to attract the attention of potential immigrants to the new community, and some of the hyperbole indulged in must have provoked chuckles among readers familiar with the actual conditions in the tiny settlement: Yancton (sic) is improving steadily, and what promises a future healthy growth for our young city, is, that the surrounding country is rapidly filling up with substantial farmers.

Although an 1862 newspaper article indicated that he was still associated with Todd's land company (now known as the Yankton Land and Town Company), the following advertisement, published in June, 1861, makes it clear that Stutsman was engaging in business activities that came very close to competition with his employer: DAKOTA LAND AGENCY OF ENOS STUTSMAN, YANCTON, (sic), D. T. Prompt attention given to the selection of choice land claims in Southern Dakota; attend to the interest of Settlers and Pre-emptors in the Yancton (sic) Land District; Land Warrants and Scrip bought and sold at current rates; attend to the sale and purchase of claims and Town Lots; and Land Warrants furnished on time to settlers, on reasonable terms.

The Yankton representatives thought they had assured the confirmation of their town as capital in behind-the-scenes negotiations before the Legislature convened, but the supporters of Vermillion, led by the Speaker of the lower house, launched a strong attack on the arrangement. Tempers flared. The Speaker, when he heard a rumor that the sergeant-at-arms, in league with some of the Yankton supporters, planned to do him violence, appealed to the governor. The governor ordered the posting of an officer and twenty men from the Dakota Cavalry at the legislature.
